Same-Sex Marriage – What Employers Need to Know

Probably one of the most significant rulings by the U.S. Supreme Court in recent times, in a split decision, the Court ruled that same-sex marriage is a constitutional right in all 50 states. As opponents to same-sex marriage debate the constitutionality of the recent decision, employers should begin rewriting their employee handbooks and policies and notifying their human resource departments of the new changes.

Same-sex couples are now entitled to COBRA benefits, disability, social security, maternity and paternity leave, flextime and health insurance benefits. Same-sex couples are also entitled to Family and Medical Leave Act (FMLA), among other benefits traditionally afforded to heterosexual married couples.

It is best to start implementing these changes as soon as possible so as to avoid the risk of any potential claims against the employer, and in this firm’s view, not only is it the law, it is the right thing to do.
